A number of London’s prominent festivals are facing an unpredictable future after local residents triumphed in a legal dispute to prevent a major park from hosting events.
With the support of Oscar-winning actor Mark Rylance, the campaign has compelled the council to verify that events will be canceled this summer.
Brockwell Park in Lambeth has historically been a favored venue for some of the United Kingdom’s largest festivals.
Each summer, hundreds of thousands of people visit the park to enjoy events such as the Mighty Hoopla, which was scheduled to feature performances by Kesha and Jade Thirwall this year.
Nonetheless, residents decided to take action against the festivals after the park was described as a “mud-bath” following prior events.
Rebekah Shaman, a member of the Protect Brockwell Park group, successfully filed a lawsuit against Lambeth Council regarding the use of the park for the upcoming event season, which begins on May 23.
The High Court was informed that the case centered on the council’s decision to certify the use of the land as lawful, noting that the park can be utilized for 28 days annually.
Mr. Justice Mold ruled in favor of Rebekah, indicating that sections of the park would be employed as an event space for more than the permitted 28 days.
Consequently, events such as Brockwell Live and the Mighty Hoopla might be prohibited from taking place there.
Rebekah and her legal team sent a letter to the council inquiring whether the “event has been canceled” and demanding they remove any barriers or infrastructure.
The draft correspondence from Goodenough Ring solicitors asserted that Brockwell Live lacks planning permission and cannot utilize permitted development rights, with any planning application not being processed for at least three weeks.
The letter stated: “This implies that not only does Brockwell Live lack planning authorization, but obtaining permission cannot occur until after the events have concluded.”
It further stated: “Given the absence of planning permission for the Brockwell Live event, the event must be canceled.”
Goodenough Ring has requested a reply by 10 am on May 19.
A spokesperson for Lambeth Council commented: “We are presently evaluating the implications of this judgment and determining the next steps.”
The court ruling was met with applause from Dunkirk actor Mark Rylance.
The Oscar-nominated actor remarked: “Wonderful news. Brockwell Park will again be free for everyone this summer. No walls. No trucks.
“The grass, trees, and plants will have the opportunity to recuperate from years of neglect.
“Let’s now work to revive the cherished Lambeth Country Fair to its former glory, welcoming everyone. Kudos to all who dedicated their efforts to achieve this outcome.
“Every small victory for nature counts.”
However, the cancellation of the event poses a significant setback for London’s struggling events sector.
Critics have noted that complaints from local residents have resulted in the closure of many major venues in London.
Yet, in April, Mayor of London Sadiq Khan received enhanced powers to safeguard the city’s pubs.
The Mayor will now have the authority to prevent councils and residents from shutting down late-night operations of pubs and clubs.
The expanded powers were supported by Chancellor Rachel Reeves, who stated that “unnecessarily burdensome regulations” were stifling London’s events industry.
