The Seoul Central District Court has determined that the K-pop girl group NewJeans cannot perform any entertainment activities independently or via third parties without prior consent from their agency, ADOR. This decision effectively restricts the group from any engagement without the agency’s involvement.
On May 30, the 52nd Civil Division of the Seoul Central District Court partially approved ADOR‘s request for an injunction to maintain the current contract status and prevent NewJeans from entering into separate advertising agreements. The court indicated that the members of NewJeans are prohibited from partaking in entertainment activities independently or through third parties without the prior approval or consent of ADOR until a ruling on the validity of their exclusive contract is reached.
This ruling is intended to uphold the status quo amid the ongoing legal dispute between NewJeans and ADOR regarding the legitimacy of their exclusive contract. Additionally, the court introduced a penalty clause that obligates NewJeans to compensate ADOR with 1 billion KRW (around $730,000) for each breach of the injunction. The court also mandated that NewJeans cover the application costs.
Earlier, on March 21, the court fully granted ADOR’s injunction request, which prohibited NewJeans from entering promotional or advertising contracts outside the agency. When the members of NewJeans lodged an objection to the ruling, it was denied on April 21, reaffirming the previous decision.
This recent ruling not only bars NewJeans from engaging in independent activities but also reinforces ADOR’s legal standing regarding the contract’s validity. However, NewJeans maintains their position for termination of the contract, citing a breakdown of trust, indicating that the legal dispute between both parties is likely to escalate depending on the main trial’s outcome.
The second hearing in the primary lawsuit between NewJeans and ADOR is set for June 5.
